Houston Summers, 28, a former singer, was arrested on suspicion of DUI on May 2, 2012.
He was pulled over due to irregular driving. The officer stated that they smelled marijuana and that when they tried to question him, he was incoherent.
The pressures of fame and success weighed on Houston, and he experienced an emotional breakdown where he was suicidal. He was institutionalized for a year.
He has been released but will likely face charges of driving under the influence of drugs.

| DWP Supervisor Charged With DUI |

Isaac Chavez, 43, the supervisor of a Department of Water and Power, is being charged with driving under the influence.
Charges were filed Monday April 30, 2012 against Chavez who is suspected of crashing his vehicle into three cars while driving drunk.
Chavez had two open containers of what appeared to be vodka in the truck.
Chavez was booked and released on a $15,000 bail.
He has a hearing scheduled for May 17 where he will face driving under the influence charges.

| Bobby Brown Faces Maximum 1 Year in County Jail |

Bobby Brown, 43, pled not guilty Monday April 16, 2012 to three misdemeanor charges related to driving under the influence.
He faces charges of driving under the influence, driving with a blood-alcohol level above 0.08% and driving with a suspended license. Brown was pulled over for talking on his cell phone.
Brown's plea was entered by his attorney in Van Nuys Court.
A pre-trial hearing is set for March 16.
He faces a maximum of a year in county jail if convicted.

| Man Hits Gas Tanker and Cited For Misdemeanor DUI |

Hakop Maghakyan, 25, of Glendale, was cited on Easter Sunday for misdemeanor DUI and released.
Maghakyan rear ended a gas tanker at a high speed which caused the gas tanker to flip over and burst into flames. The car Maghakyan was driving also burst into flames.
No one was injured.
Maghakyan was arrested on suspicion of driving under the influence.

| American Idol "Bikini Girl" Arrested For DUI and Alleged Hit and Run |

Katrina Darrell, the woman who auditioned for American Idol back in 2009 with a bikini, was arrested on Friday March 30, 2012 for allegedly driving under the influence.
Darrell ran a red light and crashed into another vehicle. She tried to allegedly flee the scene but a nearby officer heard the crash and pulled her over.
Her mom was in the passenger seat and Darrell claimed that she was driving her mom to the hospital because she had fallen down.
The officer smelled alcohol on Darrell and performed a field sobriety test. She failed. She was arrested for DUI and taken to the police station to receive a breathalyzer test where she blew a 0.15 and 0.17 (legal limit is 0.08).
Darrell not only faces a driving under the influence charge but may also face hit and run charges.

| SoCal Legislator Arrested on Suspicion of DUI |

Assemblyman Roger Hernandez, 36, of the 57th District based in West Covina, was pulled over by Concord police about 2:05 a.m. Tuesday March 27, 2012 due to swerving and failing to use turn signals.
The officer observed signs of intoxication and gave Hernandez a field sobriety test after which the officer arrested him on suspicion of DUI. He was taken to county jail and has been released since.
A 29-year-old woman who had been riding with Hernandez was released at the scene, police said.
Hernandez claims that he had a glass of wine with dinner and that the police had no probable cause to pull him over.
Police are waiting for the blood tests before deciding whether or not to present a case to the prosecutors.

| Woman Arrested For Felony DUI |

A Sacramento woman was arrested in Carmichael this past St. Patrick's Day weekend for driving while intoxicated and causing a vehicle collision that injured three teenagers, the California Highway Patrol announced Tuesday.
At about 12:50 a.m. Sunday March 18, 2012, Kaitlin Bennett, 26, was driving as she approached a red traffic signal. As Corey Dick, 18, from Sacramento was making a left turn onto northbound Hackberry on a green arrow, Bennett failed to stop for the red traffic signal and her vehicle hit Dick's car.
Some of the passengers failed to wear seatbelts and were ejected from the car and severely injured.
Bennett and her 26 year old passenger, Cortney Kavanas of Sacramento were not injured in the collision.
Bennett was arrested for a felony DUI with a blood alcohol content of more than .08 percent.

| Drunk Driver Causes Collision By Driving The Wrong Way |

A car collision, which occurred on the night of March 9, 2012 in Folsom, California sent four people to the hospital. The collision was caused by an alleged drunk driver.
The incident occurred when a Nissan Sentra and a Toyota Camry collided head-on.
The driver of the Sentra, Karen Ann Benedict, 32, caused the accident by driving the wrong way. Benedict was arrested for driving under the influence resulting in serious injuries.
The three family members traveling in the Camry were treated at local hospitals for serious injuries.

| Man Pleads Guilty To DUI Crash That Severely Injured Nine Year Old |

Andrew Vargas, 22, has been sentenced to one year in jail for a hit-and-run crash that severely injured a young boy who was visiting with his family from Pennsylvania.
Vargas pleaded guilty to one felony count of driving under the influence of alcohol causing injury and an enhancement of causing great bodily injury under a plea agreement.
Ryan White, nine years old at the time, was walking with his family in a crosswalk as they headed back to their hotel after attending a baseball game between the San Francisco Giants and the Philadelphia Phillies when he was hit by a pickup truck driven by Vargas.
Ryan suffered a broken pelvis, leg, ankle and a lacerated liver.
Vargas, in addition to the one year jail sentence, will be on probation for five years after he's released from jail.
He was also ordered to take nine months of DUI classes and serve 100 hours of community service

| 23 Year Old Councilman Arrested For Alleged DUI & Child Endangerment |

Jesse James White, a 23-year-old city councilman in the Central Valley was arrested on Monday February 21, 2012 on suspicion of driving under the influence and child endangerment.
Oakdale officers were called to a scene of an accident and found a witness holding down White who allegedly tried to run away.
A small child was in the front seat and had suffered minor injuries.
White was arrested two years ago on drug possession charges. He was being sued by the City Council in 2011 to have him removed from office; the suit was dropped a few weeks ago.

| Church Van With 11 Passengers Hit By Alleged Drunk Driver |

On Saturday February 11, 2012, a church van was hit by a black BMW around 4 a.m.
There was eleven people in the van and all eleven suffered minor injuries but none were life threatening.
The suspect, whose identity has not been released by police, was arrested and booked for felony DUI.

| Man Charged With Vehicular Manslaughter For Deadly DUI Crash |

Russell Hanson III pleaded not guilty to three felony counts and denied all allegations listed in a criminal complaint charging him with vehicular manslaughter.
Last year, Hanson was driving a 2007 GMC Yukon eastbound on the 210 Freeway about 9:53 p.m., when the Yukon crashed into a 1994 Lincoln Town Car that was stopped on the right shoulder of the freeway.
Victor Manuel Aviles, 77, was sitting in the back seat of the Town Car and died at the scene. The driver of the car, 76, suffered head and chest injuries.
Hanson was arrested on suspicion of driving under the influence.
Hanson was charged with gross vehicular manslaughter while intoxicated, driving under the influence of alcohol and a drug causing injury, and driving with a .08 percent blood alcohol causing injury.

| Man Arrested for Alleged DUI and Driving on a Suspended License |

On Saturday January 21, 2012, John Tippins, 31, a suspected drunk driver driving a Nissan crashed into a Toyota with three occupants. The three, including a 2 year old child, were taken to a hospital.
The police pulled over the car when they noticed it swerving and almost hitting another car. Instead of pulling over, the car sped away at about 80 mph and crashed into the Toyota.
The Police found open alcohol containers in the Nissan and the Tippins was arrested on suspicion of driving under the influence and for driving with a suspended license.
Tippins also had a warrant for DUI and for felony evading arrest.

| Man Violates Probation As He Drives on a Suspended License |

Ruben M. Vasquez, who at 28, had two convictions for drunken driving was seen by an officer walking in a swerved manner.
Vasquez had just come from a hearing where a judge checked to see if he was meeting the terms of his probation consisting of not driving due to a suspended license.
The officer followed Vasquez for three blocks and then observed him getting into the passenger side of a van.
Vasquez then got on the driver's side and pulled away from the curb.
Vasquez was pulled over immediately.
Vasquez was arrested and his van impounded. Vasquez is likely to stay in jail until February of 2012 for violating his probation.
Authorities heavily monitor those people with at least two DUI convictions by staking out in front of their homes and following them to make sure they do not drive to and from their court hearings.
Last year, the unit made 104 arrests out of about 400 to 500 re-offenders they were monitoring. Vasquez's arrest marked the 100th of 2011.

| Woman Faces 5th DUI Charge |

Wendy S. Myrick, 41, is being held in the Ada County Jail on a felony DUI charge after Meridian police say she was caught driving drunk on Eagle Road.
Myrick was pulled over around 7 pm on Sunday December 4, 2011 when she was seen swerving in and out of her lane. The officer detected alcohol odor; Myrick failed the sobriety test; and her blood alcohol level was above the legal limit of 0.08.
Myrick has had 4 previous DUI arrests in the past 10 years in California and Washington.
Myrick was arrested and booked into the jail and faces up to 10 years in prison.
DUI's are charged as felonies in Idaho if someone has three or more in a decade. In California, usually, a fourth DUI conviction, a DUI with injury or vehicular manslaughter will be charged as a felony DUI.

| Accident Involving Two Drivers DUI, Leaves Three Children Injured |

Three children were placed under the care of the Los Angeles County Department of Children and Family Services this morning after a van in which they were passengers in collided with a car in Van Nuys. According to authorities, both drivers were driving under the influence of alcohol.
Sgt. Don Kelly of the Los Angeles Police Department's Valley Traffic, said the children were not properly secured in the van but fortunately none were seriously hurt.
The parents of the children had been drinking and called a friend to drive them home, but the friend had also been drinking, said R. Shaffer of Valley Traffic.
Not only were the children placed in danger with a drunken driver, but they were not properly seated as well. A 4-month-old girl was in a tub used to wash feet instead of a baby car seat. A 2-year-old boy who had not been placed in a child safety seat suffered a red bruise on his cheek, and a 4-year-old girl sitting between her parents on a back seat had lump on her left cheek, Shaffer said.
The Mustang driver, who was also driving under the influence, was taken to a hospital for treatment of more serious injuries, he said.
Both drivers will face DUI charges. The driver of the van will also be booked on three counts of felony child endangerment because "it was his responsibility to make sure the children were in the proper restraints when he was driving," said Kelly.
Investigators were also talking to the Department of Children and Family Services in regards to whether the mother should face charges in connection with the case.

| Drunk Drivers Nabbed Leaving the Del Mar Racetrack |

The Del Mar racetrack had a big opening day yesterday. A record crowd of 46,588 people showed up. As a result, it was a big day for the task force of police agencies at the event waiting to stop race fans driving home under the influence. Officers from 9 different agencies made 349 traffic stops and administered sobriety tests to 56 drivers.
A total of 15 DUI arrests were made, four for driving without a license, and two for drug possession. According to officials, more enforcement is planned.

| Pregnant Woman Injured in Suspected Drunk Driving Accident |

Authorities attempted to pull over a man for a traffic stop at about 3:18 a.m., but the man refused to stop. After a short pursuit, the driver crashed into several parked cars and then attempted to flee the scene. Police established a perimeter and were able to arrest him later. The passenger of the vehicle is pregnant, but she suffered minor injuries.

| Former Sheriff's Deputy Gets Sentenced Doubled For Showing Up to Court Under the Influence |

A former sheriff's deputy who previously showed up drunk in court to face a DUI charge, had his sentence doubled today in court by an Orange County judge. He was sentenced to 32 months in prison.
Allan James Waters, 38, was supposed to receive a sentence of 16 months in state prison for his DUI conviction, but after appearing in court under the influence of alcohol, the judge withdrew the offer. James has been in custody since June 10 after a judge determined he was not fit to be sentenced.
Waters pleaded guilty April 7 to felony driving under the influence causing bodily injury, two felony counts of selling a substance in lieu of cocaine, nine felony counts of obtaining a controlled substance by fraud and a sentencing enhancement for causing great bodily injury to a 78-year-old woman.
During the June 10 hearing, court baliffs noticed Waters was showing signs of intoxication. He had unsteady balance and smelled of alcohol. One of the terms for his bail of $100,000 was that he was prohibited from consuming alcohol.
The prosecution requested an increase in bail, and Waters was taken back into custody on $250,000 bail. The judge postponed the sentencing at that time, but not additional charges were filed for this incident. At Friday's hearing, Judge Frank Fasel withdrew his previous sentencing offer of 16 months in state prison, due to the defendant's conduct. Water's accepted the new offer.

| Ryan Dunn, Star of Jackass, Dies In Car Accident |

Police have confirmed that Ryan Dunn, 34, died early Monday morning in a car crash. Dunn was one of the stars from the show 'Jackass', and was known for pulling off some crazy stunts to the delight of his fellow thrill-seeking buddies.
The collision occurred at about 3:00 AM Monday morning, when Dunn's 2007 Porsche careened over the road's guardrail and into the wood before bursting into flames. It has not been confirmed if drunk driving was involved, however Dunn tweeted a photo of himself and two friends drinking just hours before the accident.
"Preliminary investigation revealed that speed may have been a contributing factor to the accident," police said in a press release. At this time the report categorizes the incident as an 'Auto Accident' rather than a DUI.
Both bodies suffered severe burns in the wreck and were initially unrecognizable. Police have confirmed that one of the victims was Dunn. The identity of Dunn's passenger will be revealed pending autopsy due out later today.
"Ryan was a wonderful person he really was the sweetest and nicest guy- he was like my extra son, everybody loved him," April Margera said.

| Woman Might Be Denied Bail for Showing up to 6th DUI Hearing Intoxicated |

Police were prompted to revoke the bail of a woman who showed up to her sixth DUI hearing intoxicated. Sandra Uher, 54, was charged with her 6th DUI in March. According to police, her blood alcohol content was .30. She was released from jail after posting $10,000 of her $100,000 bond, but after showing up to court under the influence, she may not have that option.

| Man Charged with Gross Vehicular Manslaughter after a Car Crash that Killed his Friend |

James Ralph Huff is scheduled to be arraigned Friday on charges of gross vehicular manslaughter for a 2009 car crash that killed his friend, 28-year-old Miguel Barahona. Huff was charged on March 24th with gross vehicular manslaughter while intoxicated. According to Farra Emami, a spokeswoman for the Orange county district attorney's office, Huff was driving at speeds up to 100 miles per hour when he lost control of his 1996 Porsche. The car hit a curb, slammed into a tree, uprooting it, then smashed into a power pole. Huff was pulled out from the car, which caught on fire, by witnesses. The passenger, Miguel barahara, was burned to death in the car, Emami said. Huff could face up to 10yrs in prison.

Rick Springfield was arrested on suspicion of drunken driving on suspicion of drunken driving on Sunday night. The rock singer was pulled over for speeding on PCH. Springfield failed a field-sobriety test and then submitted to a breath test. His BAC measured at 0.10 percent, exceeding the 0.08 legal limit. He is scheduled to appear in court on July 5th.

| Woman Facing Possible Felony Charges For DUI Causing Injury |

Miriam Delgado, 24, is facing possible felony charges for allegedly driving while under the influence and causing critical injury to a 7 year old child. She was booked on suspicion of child endangerment and driving under the influence of alcohol or drugs. The single-vehicle accident occurred about 4:20 a.m. According to Lt. Oscar Serrano, "for unknown reasons," the vehicle veered to the right and hit a palm tree. The child apparently was not wearing a seatbelt.

| Faulty Breathalyzers Cause Prior Convictions to be Reexamined |

In January, Ventura county deputies first noticed a faulty reading on breathalyzer devices. They continued to see problems in seven more devices. Authorities said the Ventura county sheriff's department will remove all 125 machines from service, and prosecutors will reexamine some convictions. Capt. Mike Aranda said deputies are required to take two tests to confirm a breathalyzer's results and did not get consistent readings on the tests. "We were diligent," he said. "We were the ones that discovered the defects in the machines."
The Alco-sensor V breathalyzers were purchased in December with a state grant. According to Aranda, the sensors cost about $4,800 each. Chief executive of Intoximeters, Rankine Forrester, said testing showed similar results to those reported by Ventura officials, and the company was working on correcting the issue. "We are testing it to death to make sure we have corrected it before we implement it in the field," Forrester said. "It's a process. Obviously it's not in our interest to have instruments that produce erroneous readings."

| U.S Senators Are Requesting Apple to Get Rid of DUI Checkpoints Alerting Apps |

Senators are requesting that Apple and other companies remove the internet applications that inform motorists of DUI checkpoints. On Tuesday, four democratic senators wrote a letter to Apple, Google, and Research in Motion to persuade the companies to remove apps that provide users with information about DUI checkpoints.
"With more than 10,000 Americans dying in drunk-driving crashes every year, providing access to applications that alert users to
DUI checkpoints is harmful to public safety," according to the letter, which was signed by Sens. Harry Reid, Chuck Schumer, Frank Lautenberg, and Mark Udall.
The senators asked the companies to remove the apps.
"One application contains a database of DUI checkpoints updated in real-time. Another application, with more than 10 million users, also allows users to alert each other to DUI checkpoints in real time," they wrote. "Giving drivers a free tool to evade checkpoints, putting innocent families and children at risk, is a matter of public concern."
Some History:
In 1993 the Michigan Supreme Court held that DUI roadblocks were unconstitutional, stating that warrantless stops were a violation of the Fourth Amendment to the Constitution. American citizens are not supposed to be stopped without reasonable suspicion to believe that they had committed a crime.
The United States Supreme Court later reversed that decision in Michigan V. Sitz. According to Chief Justice Rehnquist, the stops were violations of citizens' rights- but found that these were only minimal violations. The importance of ensuring safety on the highways outweighed the minimal violations. The court left to the states the role of determining how to minimize those violations.
In the landmark case of Ingersoll v. Palmer, the California Supreme Court set the guidelines mentioned in Sitz. The mandatory procedures included "advance publicity".
Advance publicity is essential to the maintenance of a constitutionally permissible sobriety checkpoint. Publicity not only reduces the minimal violations, but it also increases the deterrent effect of the checkpoint.
In State ex rel. Ekstrom v. Justice Ct. of State, supra, 663 P.2d 992, at page 1001 it explains the value of advance publicity: "Such publicity would warn those using the highways that they might expect to find roadblocks designed to check for sobriety; the warning may well decrease the chance of apprehending 'ordinary' criminals, but should certainly have a considerable deterring effect by either dissuading people from taking 'one more for the road,' persuading them to drink at home, or inducing them to take taxicabs.

| Former President of MADD Arrested for DUI |

Debra Oberlin, a former president of the no longer operating Gainsville's MADD, was arrested on a DUI charge. Oberlin, 48, was arrested after having difficulty on a field sobriety test. She registered a .234 and .239 on the
breath test. An officer spotted Oberlin driving erratically at about 1:10 a.m., she was swerving and crossing lanes according to the arrest report. The arresting officer wrote that Oberlin smelled of alcohol and had watery, bloodshot and dilated eyes. The report states that Oberlin told the officer she had four beers.

One of Tiger Woods alleged mistresses has been sentenced to one year in jail for drunk driving. Mindy Lawton pleaded no contest last Friday to charges of driving under the influence. Lawton will also be placed on 5 years of probation, her license will be revoked for 180 days, and she is to perform 50 hours of community service. Her DUI arrest occurred in early 2009 after she crashed into another car. Her BAC was reported at .18%. The driver of the other vehicle suffered broken ribs, back and facial injuries, and cited memory loss.

| Motley Crue Singer to be Sentenced for DUI |

Vince Neil, of Motley Crue, was arrested for drunk driving last summer. He was stopped for speeding and weaving between lanes while driving his Lamborghini. According to the police report, he claimed to have consumed three glasses of champagne before his arrest, he swayed, had bloodshot eyes, smelled of alcohol, and had slurred speach. Neil failed a field sobriety test and a breath test registered a blood alcohol content nearly three times the legal limit. He is to be sentenced to two weeks in jail for DUI. Neil agreed to plead guilty before a judge on January 26. His jail sentence will begin on February 15, and he will also be sentenced to two weeks of house arrest.

| Drunken Driver Drives on the Wrong Side of the Road and Crashes Into another Car |

A 30 year old man was arrested in Burbank after allegedly driving the wrong way in the southbound lanes of the San Fernando road underpass colliding with an approaching car. The collision happened at about 12:45 a.m. Ezekial Rodriguez fled the scene on foot to a near by McDonalds. He was arrested on suspicion of driving while intoxicated, contributing to an injury collision and fleeing the scene. The names of the victims have not been released.

| Young Woman Gets DUI for Riding her Bicycle Under the Influence |

Patricia Forget, 19, was arrested for riding a bike under the influence. Forget rode her mountain bike through a red light at a major intersection and struck a car. Luckily the driver saw Forget coming and did not move. Forget used the hood of the car to steady herself and then pedaled off only to hit the curb of the median and fall over.
A police officer saw all this happen and initiated a traffic investigation. According to police Forget had red and watery eyes, laughed at inappropriate times and admitted she was "too drunk", she failed a series of sobriety tests, and had a blood alcohol content of 0.215%. She was booked for drunk riding and the bike was confiscated for evidence.
Any motorized vehicle and bicycles on public roadways are subject to California DUI laws, and their operators must have a valid driver's license and registration. The California Vehicle Code states that it is unlawful for any person to ride a bicycle upon a highway while under the influence of alcohol (or drugs). A conviction of violating the California cycling under the influence statute subjects the violator to a base fine of $250.00.

| Public Shaming on Facebook for Suspected Drunk Drivers |

The idea of using public shaming on Facebook as a new tactic against drunk driving was suggested at a Huntington Beach City council meeting. According to Lt. Russell Reinbart the city's police department is looking into posting the names of suspected drunk drivers on Facebook. Councilman Devin Dwyer asked police if they could post the names of people arrested for drunk driving on the city's Facebook page.
Their idea is part of an aggressive anti-drunk-driving initiative by the city that asks for more officers focusing on DUI cases, posting the names of people arrested for drunk driving in the city website and letters to bars when one of their patrons is arrested for DUI.
According to a July report by the city there is "a significant DUI problem in Huntington Beach," the report cites 274 alcohol-related collisions and 1,687 drunk-driving arrests last year.
The Facebook proposal will be reviewed by city attorney Jennifer McGrath to ensure there are no legal barriers.

The Los Angeles Sheriff's Department has received a $1.1 million grant to fight impaired and drunk driving. The grant was awarded by the California Office of Traffic Safety. A DUI safety campaign will be started, which will include public education, saturation patrols, stakeouts, and sobriety checkpoints. Deputies will also execute warrant searches against repeat offenders and conduct court stings in search of drivers who are driving after having their license suspended for DUI in California.

Several law enforcement agencies met at a Washington residence after someone posted new of a large party on Facebook. Eight people were arrested for being under the age of 21 in possession or under the influence of alcohol. An arrest for driving under the influence was also made as attendants left the party.
If convicted, drivers under 18 years old will loose their license for one year or until they turn 18 years old. A judge may also choose to confiscate the underage driver's vehicle. | Partridge Family Star Arrested for DUI |

The Partridge family star, David Cassidy, was arrested for a DUI. Authorities stopped his white 2008 Mercedes for erratic driving. The vehicle was allegedly traveling off the edge of the road and back into a lane several times. Cassidy admitted to having a glass of wine and prescription pain killer. A half empty bottle of bourborn was found in the back seat. His blood alcohol content was measured at 0.139% and 0.141% during the breath tests. He was booked for driving under the influence.

Matthew Nieveen, 19, dressed as a portable breathalyzer machine on Halloween and was arrested for drunken driving. He was pulled over after spotted driving erratically. His BAC (Blood Alcohol Content) level was more than twice the states .08 limit and he is not of the legal drinking age. A bottle of vodka and beer was found in his truck after a search was made.
Under the Zero Tolerance Law in California, a underage driver with a BAC reading of 0.01% or higher gets you arrested and your license confiscated. You will lose your license for a year, pay thousands in fines, and you will be required to attend driver's safety and alcohol abuse related classes. Once you are arrested for a DUI in Los Angeles County you will be given a date to appear in court. This date is called the arraignment. Most seasoned DUI attorneys will appear on this court date on your behalf. | Police Officer Pleads Not Guilty to Drunken Driving Charges |

On May 24th at about 4:30pm, a off-duty Long Beach police officer left a Long Beach bar to go to a friend's house. While driving, he stopped his vehicle at green lights and weaved in and out of traffic lanes. At one point, when he failed to start moving at a green light, the driver of the car behind him got out. walked over to the officer's car and turned off the engine. A witness called 911, and Garden Grove police arrived at the scene.
Eddie Sanchez, 30, pleaded not guilty to drunken driving charges Tuesday. He is being charged with one misdemeanor count each of driving under the influence of alcohol and driving with a blood-alcohol level of .08 percent or more, with a sentencing enhancement allegation of having a blood-alcohol level of .15% or more. He is facing up to 6 months in jail if convicted.
Nancy Pratt, a spokeswoman for the Long Beach Police Department, was unable to comment on Sanchez's status, but did provide this statement from the department's chief, Jim Mcdonnell: "Police officers are held to a higher standard both on and off duty due to the unique authority granted to them in our society. We hold our employees accountable for their behavior and expect them to conduct themselves in accordance with the law at all times."

| Hit-And-Run Driver Found at Home with Scooter Still Stuck to Vehicle |

Bruce Barber was struck by a hit-and-run driver and is being treated for a broken leg and possible broken ribs. He was struck around 11:30pm by Jessica J. Eddy who was driving a 1997 BMW. Police did not indicated how they tracked down the vehicle, but when they arrived at Eddy's home, the scooter was still stuck to the front of the car. She was arrested for DUI, DUI with injury, leaving the scene of an accident, and driving with a suspended license. She has a prior California DUI conviction and is facing charges for a August DUI arrest in which she refused to submit to a breath test.

| 13-Year-Old Girl Arrested for Investigation of Driving Under the Influence |

A 13-year-old girl was arrested after a high speed chase that ended when she crashed. She is under investigation of driving under the influence, evading arrest, and possessing brass knuckles. The chase began when an officer pulled up behind the 13 year old's vehicle. The officer said two boys and two girls got out of the vehicle and then the girl sped off. The teenager continued to drive erratically until she sideswiped a slower car causing her SUV to flip and tumble into a tree.
Under the Zero Tolerance Law in California, a underage driver with a BAC reading of 0.01% or higher gets you arrested and your license confiscated. You will lose your license for a year, pay thousands in fines, and you will be required to attend driver's safety and alcohol abuse related classes. If an underage driver has a BAC of 0.05% or greater, they could be charged with a underage DUI and a regular DUI.

| Suspected Drunken Driver Arrested After Hitting and Killing Motorcyclist |

A suspected drunken driver was arrested after hitting and killing a 23-year-old motorcyclist with his pickup truck. The Downy Police Department reported that the driver of the GMC pickup ran a red light and his vehicle collided with the motorcycle. According to police, the driver of the pickup was not injured, and was booked on suspicion of felony drunken driving.
Under California Penal Code 191.5 (a), gross vehicular manslaughter is the unintentional and unlawful killing of a human being, in the driving of a vehicle while intoxicated, where the killing was either the direct result of the charge of an unlawful act, not amounting to a felony, and with gross negligence, or the immediate result of the charge of a lawful act that might produce death, in an unlawful manner, and with gross negligence.

| Will Matt Keough Serve Time in Prison for Felony DUI |

Former major league pitcher, Matt Keough, pleaded guilty in July to a felony DUI and was sent to a 90-day diagnostic program at the California Institution for Men in Chino, so psychiatric experts could evaluate him to see if he was eligible for probation. Keough could learn today whether he will be facing jail time or not. Orange County Superior Court Judge Derek Johnson could decide to either sentence him to probation or 16 months to three years in prison.
Keough was supposed to enter a guilty plea in July, but the judge said Keough was too drunk and told him to report back to court another day. He still smelled of alcohol when he reported back to court, but was sober enough to enter the plea.
Keough's run-ins with the law date back to 2005, all alcohol related. His attorney, Harley, claims that Keough's problems sprung from a hit in the head with a foul ball in 1992 during spring training. "He's been a basket case ever since then," Harley said. "He's just a pathetic person." Harley does not have any medical proof or evaluations that being hit by the ball is what has led to Keough's problems, but the attorney did make a point that his family cites the accident as the onset of all these issues.
Officials of the probation department have evaluated psychologists reports and made a recommendation to the judge. Harley will get a chance to see the recommendation today. If it appears that judge Johnson will sentence Keough to more time in prison, Harley said he will ask for the sentencing to be continued so he can prepare his legal arguments to request the lower term of 16 months.

| Hospitalized Drunk Drivers Escaping Conviction |

According to Dr. James F. Holmes of UC Davis School of Medicine, among those admitted to the ER with a blood alcohol level above the legal limit "the conviction rate is 59 percent." Holmes and his colleagues looked at data from a large California hospital of 241 drivers who'd been admitted to the ER in 2007. These drivers were admitted with a blood alcohol level above 80 milligrams per deciliter, the state's legal limit. Of those patients, the sickest and those with alcohol levels below 200 were less likely to end up with a guilty sentence.
According to the DMV records, surprisingly the investigating police officers believed 11 percent of the drunk drivers were characterized as having "not been drinking." The ER blood samples showed an average alcohol level of 172 milligrams per deciliter. "Those guys were over the legal limit, although the officers said they hadn't been drinking, and they didn't get a DUI," said Holmes.
It wasn't necessarily out of negligence that these police officers did not report the drivers as DUI. Doctors are prevented from giving out patient information by the Health Insurance Portability and Accountability Act (HIPAA), this includes blood alcohol levels. Police often have to wait around at the hospital until the patient has been treated before they can do further investigation. During this time the patient is breaking down alcohol at a steady pace. Although it is possible to estimate the original levels given the elapsed time, it isn't often done. This could explain why the legally recorded blood alcohol levels average some 50 milligrams lower than the hospital's test results. Officers can require a blood test even if a suspected drunk driver refuses, but they only request them if there are signs of intoxication.
"There is a push among some of the injury prevention researchers at our institution to basically get a state law that would require the (emergency department) physician to report to the police that they have an intoxicated driver," Holmes said.Skeptics worry that such a law might scare injured drivers away from seeking medical attention after an accident.

| Santa Clarita Transit Bus Hit By Motorist Driving Under the Influence |

51-year-old Jeane Dexheimer of Camarillo rear-ended a Santa Clarita Valley Transit bus and was arrested on suspicion of driving while intoxicated shortly after. Moving east on Soledad Canyon Road, the bus had just stopped to allow another passenger on, when Dexheimer rammed her car into the back of the bus. Authorities say the accident took place at Golden Oak Road at approximately 10:30 p.m. on Thursday. Another source said that of the 10 passenger on board only one was taken to the hospital after complaining about a back pain. The 51-year-old had minor injuries and was hospitalized after the accident.

| Man Drives 11 Miles With 3 Tires, Charged With DWI |

61-year-old Duane Bush was arrested on Monday after Genessee County Sheriff's Department was notified by a motorist that Bush had been driving his van with a popped tire. Eleven miles later, Bush was arrested at his home in Bethany, New York. He was found to be driving with a blood-alcohol level 3 times that of New York's state limit, and a license which had been expired for 33 years. Bush was later charged with aggravated DWI and unlicensed operation of a motor vehicle.
