Criminal proceedings for Duan Van Le, 30, of Vacaville, have resumed. Van Le is facing a gross vehicular manslaughter of Gary George Hanks, 37, of West Sacramento, while driving under the influence on Interstate 80.
Hanks was standing outside of his vehicle on the side of the freeway in Vacaville at about 3 a.m. when he was struck by Van Le. Minutes later another car driven by Michael Xavier Hackbart, 27, of Fairfield, struck Van Le's vehicle which caused Hanks' body to be thrown further onto I-80.
Hackbart was also arrested for suspicion of driving under the influence.
Prosecutors initially wanted to charge Van Le with homicide but this week refilled the case with a lesser charge of gross vehicular manslaughter.
On Wednesday January 18, 2012, Van Le pleaded not guilty to the gross vehicular manslaughter while intoxicated charge and was released after posting $90,000 bail.
