What Type of Attorney Do You Need for a DUI?

I've been handling California Vehicle Code 23152 VC DUI cases for approximately 30 years.  I've been all over the place and had much success for my clients, so I think I'm in a pretty good position to at least give you my opinion on the type of attorney you need. I would say you need the following:

  • Somebody who has much experience in the particular courthouse where your case is pending, and
  • Somebody with a strong skill set has been to trial and litigated issues.

I say that because it is common knowledge in criminal defense that many DUI attorneys don't have much experience trying cases.

This is because there are not a lot of DUI cases that go to trial. After all, they're pretty cut and dry, depending on how the person's blood alcohol level was and whether or not any issues present themselves in the case.

Experience Matters in DUI Cases

So, many of these DUI attorneys don't have experience in fighting cases and dealing with challenging issues. So, I often see people coming to me who had another attorney and couldn't handle their case.

They got beaten up by the prosecutor and didn't know how to respond. So now they have to come to somebody that's a fighter and knows how to get good results. So, you might as well go to that attorney from the beginning and don't mess around with one of these attorneys without experience.

Why Type of Attorney Do You Need for a DUI?

Especially one of the firms where you call in, and the attorney that's got their name up there has nothing to do with the practice of DUI defense and is just a figurehead and using younger, less experienced attorneys to deal with their client's cases. 

That is something you do not want.  You want an attorney who has experience and is responsible for the case that you hire them to try.
