What Is The Ignition Interlock Device?

The Ignition Interlock Device, a crucial tool in preventing DUI incidents, is a concept/device that most people do not know about unless they have been arrested for a DUI in Los Angeles. The L.A. area is part of a test pilot program that requires first-time DUI offenders to install one of these devices in their car to comply with their probation and the law in California.

It is a device that registers whether you have any alcohol in your system before starting your car. The installation process, carried out by a certified company, involves attaching the device to your car's ignition system. The device itself is relatively easy to use and is reasonably priced.

A certified company must install it, and it is monitored to prevent tampering by the car's owner. If a person on probation is caught unlawfully tampering with their ignition interlock device or having someone else blow in it to avoid alcohol detection, they will be subject to probation violation. This can lead to serious consequences, including a sentence of six months to a year in jail, depending on the number of DUI convictions on their record.

The device is part of California's all-out push to stop people from drinking alcohol and driving. California has become one of the strictest states in terms of DUI deterrence and enforcement.

Believe it or not, embarrassment and shame are some of the biggest concerns people have related to their DUI cases.

Fortunately, as they have been modernized, ignition interlock devices have become smaller and less conspicuous than they once were.

The companies that make these devices realize that the consumer does not want to be seen with one of these devices on their car and have done everything to make the device as inconspicuous as possible.

The primary way to avoid putting one of these devices on your car is to beat the DMV at the administrative hearing and win your criminal DUI case in court.

If we can do this, you do not have to put the device on your car and suffer some other harsh penalties with a DUI. If this is not possible, we do everything we can to minimize and downgrade the charges and the impact a DUI can have on your driving and criminal record, providing you with the support you need during this challenging time.

Monitoring the Ignition Interlock Device

Who controls and monitors whether the ignition interlock device is placed on your car in Los Angeles? The criminal courts do not typically get involved in monitoring whether you have installed an ignition interlock device on your vehicle or in determining whether you have violated your probation related to its use.

The courts leave all of this up to the DMV, a strict enforcer of the Ignition Interlock Device. However, if you find yourself in court for violating the use of your ignition interlock device, the court will undoubtedly be more than happy to punish you for it.

Typically, the court will inform you, as part of your probation, that you are not to drive with any measurable amount of alcohol in your system and that you must comply with installing an ignition interlock device on your car through the Department of Motor Vehicles. The DMV is responsible for ensuring that you comply with this requirement, placing them in charge of addressing this complex issue.

It took the DMV some time to figure out how to implement the legislature's dictates related to the IID.

Initially, the DMV was not enforcing the law because it lacked the necessary systems or mechanisms to monitor and operate the ignition interlock device component of the legislature's requirement. They have finally figured it out and are pretty efficient in monitoring and enforcing the IID requirement. They have also been assisted by the numerous companies that profit from installing and monitoring this aspect of a DUI.
